If Only He Were King
Yesterday, in the midst of the disaster that is Obamacare, congressional hearings were conducted discussing our beloved presidents’ actions and whether they are constitutional. As many of us have known for some time, Barack has been very open about doing whatever he wants without those pesky lawmakers slowing him down. Finally, people from both sides of the aisle have weighed in!
The House Judiciary committee raised questions about how this administration ‘faithfully executes’ the laws of this nation. Two major examples of this are the delay of the employer mandate for the ACA, and the lack of deportation enforcement for illegal immigrants; the so-called ‘dream act’.
Johnathan Turley, a liberal law professor from George Washington University said…
I believe the president has exceeded his brief…..
The president is required to faithfully execute the laws. He’s not required to enforce all laws equally or commit the same resources to them…
But I believe the president has crossed the constitutional line.
So do I! This hearing had an impeachment flavor; or is this just wishful thinking?
Another Law Professor, Nicholas Rosenkranz of Georgetown agreed as well. He felt that the president had crossed the line in some of his executive decisions. He pointed out that Congress had passed a bill that would have delayed the employer mandate, which the president said he would veto, and ultimately suspended the deadline by decree. He went on….
This is wholesale suspension of law in the teeth of a clear statutory command to the contrary…
Whatever it means that the laws be faithfully executed, it cannot mean failing to execute the law at all.
Remember these are law professors; not exactly Tea Party members!
Professor Rosenkranz also believes that Obama effectively passed the ‘Dream Act’ on his own, after Congress decided not to. Pretty hard not to believe that Obama feels he can do whatever he wants. Rosenkranz continued….
Rather than declining to comply with a duly enacted statute, the president is complying meticulously, but with a bill that never became law
When democrats scoffed and called this political theater, the left-leaning Turley responded with…
We have this rising fourth branch in a system that’s tripartite… The center of gravity is shifting, and that makes it unstable. And within that system you have the rise of an uber-presidency.
There could be no greater danger for individual liberty, and I really think that the framers would be horrified by that shift because everything they’ve dedicated themselves to was creating this orbital balance, and we’ve lost it.
Who needs me tilting at windmills when Obama’s would-be friends can describe his antics so perfectly?
Representative Goodlatte, Chairman of the committee, warned that Obama’s tendencies border on Tyranny, and he reminded us about the separation of power.
Maybe he should remind Obama!
